It has been 10 days since the wreck and I still don't have a rental car. I do deliveries (200-300 miles per day) so I am driving my car with the tires rubbing on the fenders and the hood won't open so I can't change the oil that is over due now.I still have not got a number from Fred Loya's adjuster so I can get a rental car!

This is one of the most common complaints. Insurance companies that do not contact you and leave you on the limbo thinking that you do have coverage for rental and other things.

They are also covered by the "duty to mitigate damages". If your tires or engine (due to no oil)get damage because you are driving the car for 200 to 300 miles, they will not covered any of this new damage . They dropped the ball by not contacting you, but they will not cover you if you have more damage.

We know that this is unfair since you have to get to work and earn a living, however, insurance companies have certain rights (it seems more than the ones we have as consumers). Be aware of that and try to get a rental yourself and keep the receipts. It is easier to get coverage for the receipts that you have than for new extra damage.
