Another driver caused me to go in the ditch is he liable?

I was driving on the main road. The other driver half pulled out into my lane from a side street.

To avoid him I swerved and ended up in the ditch on the other side of the road and totaled my car. He got a ticket for failure to yield at an intersection. Is he liable?



Usually the issue is that the vehicle leaves the scene and you have no way to prove that the other party came out like that. Here, you have a police report and the other side was cited for failure to yield. It is very likely that the other party will be held completely liable for your damages.
