Are insurance companies supposed to have photos of an accident they are claiming for?

I recently asked a insurance company for photos of the accident that occurred between me and another vehicle as the damage and costs appear to be way more than the damage i caused.

Hello,

It's good practice for insurance companies to have pictures, however you will have two problems:


  1. They don't have to take them (they are not required to have them)

  2. If they take them, they don't have to release them (sometimes referred as a work product defense


Some insurance companies will help you and not put too much issue here. Some will not take the pictures or give them to you.

It's a hard situation.
