Car depreciation after accident

by donald miller
(orlando, fl, US)

A Moron hit my car in FL... Can I go after his insurance on the depreciation of my vehicle? I just 3 months ago brand new.

Answer

Nope. Most likely not. Florida is a no fault state, which means you are stuck with what your insurance company pays.

They will probably only fix your car but no pay the diminished value (read the policy).

Good Luck
Anne.

No Fault

NY is a no fault state. I was lways under the impression that no fault insurance only applied to medical care for injuries. Why would no fault impact pursuing the cars depreciation beyond repairs? What if the insured's insurance company is paying for the repairs?

It is state specific. Look for third party depreciation for your state. We are not sure what NY does.

Thanks!
