Drunk Driver & Pain and Suffering

In our situation we were hit by a drunk driver, does this automatically mean he was at fault? And to file compensation for pain and suffering do I need a lawyer, or how do I go about doing that?

Being drunk by itself will not make someone automatically at fault. The drunk driver must have done something negligent (other than being drunk) when driving the car. A breach of a driver duty must be shown before he can be held liable. Visit,
