Hay rake hits vehicle | Fault?

I am in Michigan. I had my Explorer hooked to a hay rake to transport it from point A to point B on a public road.

The rake was attached with the appropriate draw pin and was secured with a lych pin to keep the draw pin from coming out.

Some how the draw pin came loose and the rake came unhitched and damaged the back of the Explorer. Should I be considered 51 % at fault in this.

I did every thing you would normally do in hauling a piece of farm equipment.

Answer:

Hello,

Well, either you are 100% at fault (you failed to properly attached the pin) or the Pin failed (in which case, you may have a products liability action).

I hope this helps.

Good Luck,
