Health insurnce and auto insurance, subrogation in arizona

by Jennifer
(Ariaona)

In Arizona I was under the impression that when there is an auto accident, the health insurance company has to pay regardless of what the auto does.

Can a health insurance company stall or deny payments of a medical bill because the auto insurance has not responded?

Answer:

Hello Jennifer,

That is our understanding, however, the insurance company does have time to investigate. They can stall payment that way. We are not sure if they can deny all together. They cannot subrogate payments already made (ask for money back), but it is not clear if the can simply wait for the auto policy to pay and then deny payment. They cannot probably do that, but you need to contact an attorney in your area for that.
