Insured motorist rear ends uninsured motorist

If an insured motorist rear ends a vehicle that is not insured is the damage done to the uninsured vehicle covered by the at fault driver?
or


Will the vehicle that was struck be compensated for damage even though it was uninsured? or does that fact that it is uninsured make it at fault for the accident?

Hello,

The at fault driver owes for the property damage he/she caused. The "unisured" status is irrelevant on the issue of negligence. Please see: http://www.auto-insurance-claim-advice.com/Fault-for-the-Accident.html.

The only variant to this would depend on your state legislation. In California, if you do not pay for insurance, you do not recover. But that's about it.
