Liability for this accident?

My car was parked and hit by someone who says he was involved in hit and run .the person he claims hit him left scene.

I called his insurance company to make claim and was told there not responsible. I live in New York state and want to know if this is true.

If it is true that the person that hit you was hit by a hit and driven and they have not negligence/liability, then yeah. You would have to go against the hit and run driver.
