by Joe
(Tampa, Florida)

My car is being repaired due to a collision that is not my fault. State Farm (the liable insurance agency) states they do have to pay for a rental car but they do not have to pay for the additional loss of use insurance.

Answer to Loss of use coverage

Hello Joe,

This is a state specific issue. The insurance company, in the majority of states, do not have to may for the "extra insurance" on a rental car.

Typically, states take the view that you had to insurance your own car regardless of the accident. Just like gas, it is an expenses that you are supposed to pay anyway.

The minority of states think that extra insurance is an added fee that you would not have otherwise. Best thing for you is to contact the department of insurance of Florida and see if they are telling you the truth.

Also talk to an attorney.
