New car with parallel feature | fault when parking

by R Davis
(Ogden Ut USA)

If you have a new car able to parallel park it's self who's at fault if it scratches another car?

Answer:

Yours. I mean the drivers.

Simply because your car has this feature, it does not release the liability of the driver. The driver must learn how to operate the vehicle and ensure that it will not cause damage to others.

It's very much like putting a car in cruise control, if an accident occurs, the driver is the one who needs to know when to engage or disengage the system. Same here.

You could make an argument that the vehicle manufacture could have some liability under a product liability theory, but again, the driver will at least be jointly and severally liable, at least on negligence concepts.

Good Luck
