Partial settlement check | Waiver of all rights?

I was offered a partial settlement check from a large insurance company.

If I accept this check, can I still go to California Small Claims court to obtain more money to fix my car and obtain rental car etc.

Or once I take their check I cant go to small claims and the situation is done and closed ? Thank you so much for your advice !

Hello Tony,

It depends on what kind of language the settlement (the back of the check) presents. If this is a clear “partial settlement”, you could still have rights in court.

However, if you waive those rights or sign them away, they could be completely gone.
