Private property parking lot and fault issues

by Rebecca
(South Carolina)

My mother was driving through my apartment complex and someone backed into her car.

We live in SC and the owner of the other vehicle stated that because the accident occurred on private property she would not have to pay for damages, even though in the police report she is clearly stated at fault.

I have never heard of this before and was wondering if it could be true.

Answer:

Hello Rebecca,

Nope, it is not. You are responsible for the damages your negligence cause anywhere (even outside of the country). If you have more problems, consult an attorney.

Sometimes police does not answer to parking lot accidents because they are private property (they have no jurisdiction over the road of a private person), but sometimes they do. This might be the misunderstanding.

Good Luck,
