Side swyped from rear in parking lot? | Who's at fault?

I had my car in reverse, getting ready to back up but was not in motion. Car came too close to my bumper and swiped my cars rear end and then took off. who's fault is it?

Answer:

Hello,

Parking lot accidents are very hard (usually fault is split). You question does not give us enough details to help you. - how big is the parking lot? How big are the stalls? Was is it in the day time? Are the stalls straight or are they diagonal? Etc.

If your car was parked and you did not move, the it's likely more their fault than yours (assuming that you can show that).

If on the other hand you were baking up or you did move, then more investigation is necessary.
