Two seperate damage incidents occured to my vehicle....

My truck was hit and towed to a body shop. The defendant's insurance company sent an adjuster who estimated and cut a check for the damages.

Subsequently, after this matter was settled and before repairs were authorized, the truck was in a flood at the body shop and sustained total damage.

My insurance company has totaled the truck and is now calculating its value. This is a separate claim correct? he cannot ask for the 3rd party's payment for the original damage is my contention. Please advise...Thank You. David

Who is he? The insurance company or the bodyshop.

If the truck was fixed, then the total loss value would be normal. If it was not fixed, then your insurance company will be able to deduct the amount of the repairs.
