What should I do? | 7 car accident no enough money for me

by Christian Z
(Avondale, AZ)

Back on October 13, of last year (2008) I was in what may be considered a major accident about 7 cars involved. There were not any injuries to anyone but the guy who was at fault.

However there was mass damage to city light poles and 2 new dealer cars and the next big damage would have been my car. I saw an adjuster couple days later and i believe my estimate is $5,200 and it was considered a total loss.

Well up to this day 5 months later I have not received any money and when I call they tell me that they are still taking all estimates but they say that the guy who was at faults policy does not have enough money to pay for everything.

Again because of the city light poles and im guessing the dealer's cars. So is it possible that this is true? Do policies have limits?

Or can i still get my full estimate? Should I get a lawyer maybe? Thanks you guys for allowing me to submit this question and any advice you might be able to give me.

Answer:

Yeah, policies have limits. All states have minimum required limits, but they can be very low (depending on the state, as low as $10K). Remember, this is a “minimum” requirement; it is possible that they have higher limits than the minimum, but again, we do not know what they have.

It is wise for you to get a lawyer right now. Your car might not be paid for by the insurance company or you will only get a percentage of your damages (i.e. only 50% of what it takes to fix).

You are entitle to 100% compensation, but an insurance company might not pay you all of that, talk to a lawyer to see if they can help you collect from other sources (state funds, your own policy, other possible insurance polices of the person that hit you).

Good Luck,
