Where can I find laws to support particular arguements?

by Jonathan
(New Orleans)

I have examined the CCC report, and only two comparable vehicles are included. The closest one is 200 miles away. This is certainly not local, and this website says it should be within 30 to 50 miles. How can I make the insurance company stick to this figure?

Hello,

You seem to have couple of questions. One is where to find laws that support that insurance companies should not give you comps over 30 to 50 miles.

Some states have the total loss process codified within their state codes. Some other jurisdictions have it in case law. Finding case law information can be difficult if you do not have access to West Law or Lexis Nexis.

The best bet for consumers is to contact their state department of insurance and ask what the exact guide lines in that state.

also check
http://www.totallosssettlement.com/
to see if the particular insurance company is involved in prior litigation for the same reason.

Your second question:

How can I make the insurance company stick to this figure?

By pointing out that 200 miles is not your fair MARKET value as they are not in your MARKET. They need to independently appraise your car or take other values into account.

Good Luck,

Hector.
