Who pays for the Deductible?

I live in the state of New York and recently got into an accident. I hit the car in front of me.

My car had absolutely no damage but the other driver's car is a total loss. The driver now had ask me to pay her deductible of $1,000 which I first agreed on but I now found out that in the state of New York it would be illegal to be ask to pay someone's deductible in case of a total loss.

I would appreciate if anyone could clarify this for me.

We do not know why this would be illegal? Who told you that? Did you talk to an attorney?

Settling things out of court is not illegal and actually encourage by the courts. Talk to a local attorney so you can determine if you are violating any law.
