Who receives pay out if a vehicle is written off after an accident, but there is a lien on it?
The accident wasn't our fault, we were rear ended. The insurance co. is going to write it off. There is a lien on the vehicle that is more than the vehicle is worth.

Looks like you are upside down on the loan. The insurance company will pay the lien holder, and you will still be responsible for the remainder of the lien. It's a very unfair situation, but that's how this situation works.
