by Steven
(Killen,TX,us)

I was driving down a 4 lane road going east. A guy pulled out of a gas station right in front of me.

I swerved to avoid him which I did, but hit a truck going west bound is that my fault or the guy that pulled out right in front of me he and the guy that I hit all said it was his fault and I couldn't stick around do to the fact that my kids where injured.

Answer:

Hello Steven,

If the vehicle caused you to swerve out of the way, and there was no other way to avoid the collision, they will be negligent (at fault) for the accident.

The insurance company may argue that you are also liable if they believe you over reacted to avoid the collision. That would be up to all the evidence
