Personal Injury Claim

Will I have to pay a deductable?

by Barb
(Mansfield ohio)

While unloading a single bed from my house through the garage, a lady fell on the steps slamming two wood slats into my husbands side of his truck.

Does that all fall on my homeowners insurance and will I have to pay the deductable?

Is the lady that did it liable?

Answer:

Hello Barb,

I am sorry to hear about your situation. You ask if the lady is liable, well, there is not enough facts here to determine that. If she did something wrong (not paying attention) probably yes. The problem is, will you will be able to collect from her.

Damages to your car are almost never covered under a homeowners policy. Homeowners insurance does cover personal property, however, the exclusions of coverage exclude vehicles.

If you make a first party claim against your auto insurance, you will have to pay a deductible (if you have one - most consumers have deductibles).

I hope this helps,

Good Luck,
