15 year old totals car | Permission to drive issue

by Russ
(PA)

A 15 year old takes there parent's key's when they are asleep and totals the vehicle. How does the insurance company deal with the claim.

Answer:

Hello Russ, the insurance company must do a coverage investigation. Permission is the big issue here. If the 15 year old does not have permission to drive the car, there many not be coverage.

Permission can be express or implied. Here, looks like there is no express permission, so we must look at the imply permission. Each state has different regulations on this, so it depends on your state law.

Talk to a local lawyer about it.

Good Luck,
