Can I sue even if I was not hurt?

If other driver is at fault, can you sue his insurance if you are not hurt?

Answer:

Well, you cannot sue the insurance company as they have done nothing wrong. You can sue the individual and the insurance company will defend/pay if there is coverage and if there is liability on that party.

If you are not hurt, you cannot sue for injuries as they aren't any. But you can sue for damages to the vehicle, if any.
