Can I sue my wifes insurance if i have an accident in her car

Tire blew on highway,the car flipped twice and my passenger and I were both taken to the hospital.

We are fine but both having back pains,the insurance says that because I had insurance that lapsed in April they will not pay my medical bills.

Answer:

We don't think you could sue your wife's insurance company successfully.

You, the driver, has the duty to inspect the vehicle and make sure everything is safe before driving. If you failed to do that, then it is your fault.

Your passenger definitely can sue you for the negligence described above.

You may have a products liability claim against the manufacture of the vehicle and/or tire.
