Claim total loss when the owner was not driving

My father had a car we were letting a friend drive it but they were not on the insurance. Our friend got in an accident not their fault hit and run but the car is totaled....

The problem is the accident happened the night before my father died, but they didn’t tell me about it until 4 days later because they felt bad. Can I still claim it?

Answer:

Hello,

We are sorry to hear about your dad.

You cannot claim. The estate of your dad may make a claim. If the estate has an executor or a PR, that person may make that claim. You may be that person, but even if that is the case, you can only make the claim on behalf of the estate.

Call an estate lawyer locally for more details about your local jurisdiction.
