Courtesy Car | What am I entitled to?

If my car is hit by a third party am I entitled to a courtesy car at his expense until the claim is settled. And if a courtesy car is not provided can I claim for compensation?

Answer:

It depends of your state law.

Most states allow you to get a rental car if the claim is clear liability (you were not at fault - and it's clear that you did not).

However, the length of time that you are entitled to a rental car varies from state to state.

If you have a total loss, you will only be entitled to a rental for a shorter period of time that you would if the car was fixable.

Some states and insurance companies will cash you out but some will not. You have to discuss with them and see if they give you that option.
