He said he had insurance

I was hit on Monday and he said he had insurance. Because we were in the store parking lot the police told us to just exchange information.

So I told him to call his insurance company so I can talk to them instead he made a payment now they telling me he wasn't cover yet can I still sue?

The next day I called the insurance company they told me he was active.

Yes you can sue. You can always sue, even if there is or not insurance.

Talk to an attorney to see if you can compel them to make a coverage determination. Your insurance company should cover your damages unless you don’t have coverage.
