How long does the insurance company have to settle with me if my vehicle was totaled.

My vehicle was hit while it was parked in the parking lot of my apartment complex...

The adjuster came out and said that my vehicle would be ruled totaled. They said the damage done to my vehicle exceeds the costs of my vehicle.

They estimated the damage to be 3000 dollars. But they only want to give me 1100 for my van.

If I don't accept their offer how long do they have to reach an agreement with me?

Well, they have as long as the statute of limitation allows (could be 2 to 3 years, but you need to check).

They are not bound by anything as they are third parties. They are not acting as your own insurance company so they do not have to settle. They will probably try to make a payment for that amount and called it good.
