Ilegally parked | fault issues?

I back into someone illegally parked on a red curb in front of parking spots and the driver was not in the vehicle.

I did not see the car because it was in a blind spot, who is at fault?

Hello Causha,

Chances are that both vehicles drivers are at fault (maybe 50% split?). The vehicle backing has the duty to look out and ensure that there are not vehicles behind. If the driver has a “blind spot”, then the driver should have ensured no vehicle was possible there (could have been a child).

On the other hand, the illegally parked vehicle is not supposed to be there. Probably, both drivers would be liable. Please see:
