Liability for damage on private property

An employee was parked in our guarded private property parking lot; someone broke into his locked car via the passenger window.

He submitted the bill for repair to the window which cost less than his deductible limit to us; Is the company required to pay for his damages since it was on private property at the time?

Probably not. Does he pay for the parking of his vehicle? Is the Private garage making a representation as “we will be responsible for any damage? These are questions that will help answer that question.

Usually parking lots are absolved of any damage. It is an assumption of risk to the driver.
