My pregnant wife was hit head on by on-coming speeder. Why do we have to pay anything?

by Jim
(Michigan)

We have a 1996 Ford Contour and therefore only purchased MI PLPD - no fault insurance. My wife has hit, head-on and ended up in the hospital. Our claims agent said that we're only getting $500 for our totaled car, but will have to pay $500 deductible for the hospital visit.

What gives? Wouldn't the responsible parties insurance company have to pay for car damages and hospital? This just makes no sense.

Answer:

Hello Jim,

You are in Michigan, which as you noted is a no fault state. The standard to get compensation is very different, if you meet it at all.

You need to talk to a Michigan lawyer. Also, try the form below to find a qualify lawyer near you. There could be compensation if you meet the standard (it has changed, so it is best for you to talk to a lawyer).

Thanks for the tip. I tried the link below, but without injuries, it won't let me continue to fill out the form.

Answer:

If there is no injury (which, is not certain as there is a "baby" involved" and your wife should at least have the baby checked out.

Call the bar association of your city, they may be able to connect with a lawyer locally.

Good Luck.
