Right to repair a total loss vehicle

by Ken
(Vallejo, CA, us)

Hi, in California does one have the right to be made whole? My vehicle was deemed a total loss, with the damage & repair exceeding the determined value.

I want to accept the amount the insurer determined for repairs instead of their settlement amount. Is this possible?

Thanks

Answer:

Hello Ken,

If your car is a total loss, the total loss settlement makes you whole.

It's not possible to accept the amount of the repair because that is why the vehicle is a total loss. You had a vehicle worth x amount, you should get x, not the value to repair x. X is determined as the fair market value of the car.
