Theft of parts from my car after accident during towing?

by Peggy
(San Antonio, Texas)

My daughter-in-law had an accident on the freeway. The insurance adjuster came. They towed the Toyota F4 vehicle to the Toyota Dealership, then towed it to my son's choice bodyshop in his town about 60 miles away. The SUV was not totaled.

Somewhere in between the towing and fixing of the car, the expensive roof rack was stolen, his hitch was stolen and a number of other items that had been added on were missing.

The insurance company hired and employed the tow company to move the wrecked vehicle. They will only open another claim for the stolen items and will charge it against their insurance premium as another claim.

How can this happen? It is racketeering if no one challenges the cycle between the insurance company who hires the towing company. Someone along that line is gettting away with a huge amount of theft and no one is doing anything about it. Isn't there bonding or something that can be done? All anyone will say is "we don't know when the theft took place" as if it happened before the wreck. They have pictures of the vehicle before the wreck while on vacation which clearly shows the roof rack, hitch, etc.

What can they do?

Answer:

You want to file a claim with your own insurance company. You also want to file a claim against the two truck insurance company (for theft, or at least, negligent supervision of their tow truck driver)

Do contact the department of insurance and file a complaint there.

As always, you need to talk to an attorney.

Good Luck,
