Trouble with getting my car insurance people to settle

by Sara
(Raleigh, NC)

In September of 2009 I was in a wreck. There was one passenger in my car. My car was totaled. Both me and the other passenger were lucky to walk away from the wreck. Since then the other passenger has accrued medical costs of $10,000.

My insurance carriers at the time do not want to settle with her. They offered her around $2,500 and she refused it I am told. Now I have been served papers telling me I am being sued. I had more than enough coverage at the time of the wreck.

My understanding is that my insurance carrier must handle this for me. Please help me figure this out.

Answer:

Hello, yes, your carrier must handle this if you have the proper liability coverage. You are liable to your passengers if you cause an accident. This is why it is important that you talk to them about this. They will have to hire an attorney for you and they will answer and represent you.

They will also try to settle this before it goes to court .

I hope this helps,

Good Luck,
