Who is liable in rear end collisions?

by Valerie
(Hartford City Indiana )

If a car is at a full stop waiting for the traffic signal or whatever and a careless driver hits him from behind causing him to hit the car in front of him...who is liable?

Answer:

Hello Valerie,

Usually the car that hits from behind is 100% liable. There must be a reason why the vehicle is there. If it is a traffic signal, then that’s one thing, but there must be a legal reason (the car cannot simply be parked in the middle of the road). Also, the car driver cannot cause the accident intentionally (slammed on the breaks to have the other car rear end the vehicle).

Good Luck,
