Who's at fault in this parking lot accident?

I was pulling into a parking stall and waited for a pedestrian to walk behind me to their car then I backed up to straighten my car then pulling in a car hit me from behind and scraped part of my bumper off (minor damage but did cause a hole in the bumper where the scrape was).

The damage to their car was as wipe not a dent in to the passenger door. Does this show that they hit me and that I did not back into them. I was 1/2 out of the stall when we collided so they had to have seen me and were not paying attention.

Hello ,

Well, most parking lot accidents end up putting fault on both drivers. You back up so that gives you more duty as the vehicle backing must ensure no other vehicle is coming. Both vehicles probably have negligence in here.

As always, it is very important that you talk with a local attorney!
