You always conserve the rights of counsel. This means that you are always entitled to hire an attorney to protect your interest. When your insurance company is defending you, and they hire an attorney to protect you, you can hire another attorney to make sure your interests are fully protected. If you find yourself in court defending a lawsuit; the insurance company will provide for your defense, however they will select the attorney. This makes many people uncomfortable so they decided to hire separate counsel and have the two attorneys provide a defense. You must remember that the attorney, although selected and paid by the carrier, is your agent. This means that their primary duty is to you, and they are required to put your interest before the insurance carrier. But you and I know that if the insurance is paying, they have a lot of control over the attorney! Be aware. Rights of Counsel Clauses are beneficial to you. You can use Subrogation of Rights to your advantage also, but be aware; you could be burned in the process!
